Movers Money Maker Program - Package Terms

These terms apply specifically to the Movers Money Maker Program provided by Smart Leads LTD to the client. These package terms sit alongside Smart Leads' general Terms and Conditions on its website, including any applicable lead generation, advertising, website, CRM, automation, or related service terms. If there is any inconsistency, the proposal, scope of work, onboarding records, or written approval for this package will apply to the extent of that inconsistency.

What this package is

The Movers Money Maker Program is a marketing, lead generation, follow up, sales, and conversion support package designed to help moving companies generate enquiries and convert those enquiries into quotes, deposits, and booked jobs more consistently.

This package may include one or more of the following services, depending on what has been agreed with the client:

  • lead generation campaigns
  • Google Ads campaign setup, management, and optimisation
  • Meta advertising campaign setup, management, and optimisation
  • website design, landing page creation, website improvements, and conversion-focused website support
  • AI follow up by SMS and email
  • missed call text back and voicemail drop
  • quote chase automations
  • deposit and confirmation sequences
  • CRM setup, automation, and pipeline support
  • sales scripts and objection handling support
  • quote templates and sales messaging
  • call review frameworks
  • retargeting campaigns
  • creative updates and refreshes
  • dashboard and reporting
  • missed lead recovery and nurture sequences
  • automated review gathering
  • referral and reactivation systems
  • no show reduction systems including confirmations, reminders, reschedule flows, and deposit prompts

Scope of work

The exact deliverables for each client will be set out in one or more of the following, as applicable:

  • the proposal
  • the scope of work
  • the onboarding records
  • any written approval between Smart Leads and the client

For clarity, the agreed deliverables may be recorded in any one of the above documents, or across more than one of them.

Smart Leads may adjust tactics, automations, messaging, campaign structure, workflows, website elements, or related implementation details where reasonably necessary to improve performance, conversion, usability, or account stability, provided the overall service remains within the agreed package.

What Smart Leads will do

Smart Leads will use reasonable care and skill to set up, manage, and improve the systems and services included in the agreed package.

This may include lead generation, paid advertising, website work, follow up systems, sales support, reporting, CRM configuration, and related implementation work.

Smart Leads does not guarantee revenue, profitability, or any result outside the specific written guarantee agreed with the client.

Client responsibilities

To give the system the best chance of working properly, the client agrees to:

  • provide accurate business information, pricing, service areas, availability, and operational details
  • respond to leads, quotes, and booked job opportunities promptly
  • provide Smart Leads with access to required accounts, platforms, domains, ad accounts, website systems, CRM tools, and related assets
  • cooperate with reasonable recommendations relating to response times, quoting, deposits, close rate, fulfilment, and website or funnel performance
  • maintain genuine operational capacity to service booked work generated through the program
  • ensure their team uses the agreed systems, scripts, processes, and follow up workflows in a reasonable and consistent way
  • review and approve website, ad, automation, or campaign materials where approval is required

Smart Leads is not responsible for poor outcomes caused by delayed follow up, missed calls, inaccurate pricing, lack of availability, poor close rate, fulfilment issues, website delays caused by the client, failure to approve work, or failure to implement agreed recommendations.

Guarantee

Any guarantee offered under the Movers Money Maker Program is subject to change and is not fixed by these package terms alone.

The applicable guarantee, if any, will be the guarantee stated in the client's proposal, scope of work, onboarding records, transcript, or other written confirmation from Smart Leads.

If a guarantee is discussed during onboarding, it will only apply to the extent it is recorded in the proposal, scope of work, onboarding records, transcript, or other written confirmation from Smart Leads.

Any guarantee is conditional on the client:

  • making reasonable efforts to contact new leads as quickly as possible
  • following the agreed sales, quoting, follow up, deposit, and booking process
  • keeping service availability, calendar capacity, and operational capacity accurate and up to date
  • having genuine capacity to fulfil the work generated through the program
  • keeping payments up to date
  • providing Smart Leads with the access, information, and cooperation reasonably required to assess performance and guarantee eligibility

If a lead is not contacted promptly and that delay contributes to the lead not becoming a booked job, that lead may be excluded from any guarantee assessment.

If the client cannot take on a job due to calendar clashes, lack of availability, lack of staff, lack of vehicles, or any other capacity-related reason, that outcome may be excluded from any guarantee assessment.

Where the client is using a CRM provided or managed by Smart Leads, the client must accurately update lead statuses and record the reasons why leads did not become booked jobs. If those records are missing, incomplete, or inaccurate, Smart Leads may be unable to properly assess guarantee eligibility, and this may affect whether the guarantee applies.

For the avoidance of doubt, any guarantee does not apply where poor lead handling, delayed follow up, missing or inaccurate CRM records, lack of capacity, failure to follow the agreed process, or any similar client-side issue materially contributes to the result.

Timelines and performance

Any timelines, launch dates, optimisation windows, website delivery dates, or expected ramp-up periods are estimates only unless expressly stated otherwise in writing.

Performance depends on factors outside Smart Leads' control, including competition, seasonality, pricing, service quality, close rate, client response times, local demand, approval delays, platform changes, and third-party tools.

Accounts, platforms, websites, and third parties

This package may involve third-party platforms and tools, including Google Ads, Meta Ads, website platforms, domains, hosting providers, CRM systems, call tracking systems, AI tools, SMS providers, email systems, and automation software.

The client acknowledges that:

  • third-party platforms may change their rules, pricing, features, or availability at any time
  • ad accounts, domains, business managers, hosting accounts, phone numbers, CRM systems, or website platforms may require client cooperation, ownership verification, or approvals
  • Smart Leads is not liable for outages, suspensions, rejected ads, verification delays, hosting issues, platform restrictions, or third-party failures outside its control

Any third-party costs are the client's responsibility unless expressly included in writing.

SMS and text messaging terms

These SMS and text messaging terms apply to any text (SMS) messages sent or received through Smart Leads' messaging systems, including messages relating to this program and messages sent to leads, contacts, and customers through systems set up or managed by Smart Leads.

SMS program and messaging use cases. By providing a mobile number and opting in, you consent to receive SMS text messages from Smart Leads. Messages may include appointment confirmations and reminders, booking and scheduling updates, quote and enquiry follow ups, missed call text back, deposit and confirmation prompts, customer service replies, and related conversational or transactional messages connected to the services. Message frequency varies depending on your interaction with us.

Opt out. You can opt out at any time by replying STOP to any message. After you reply STOP, we will send a single confirmation message and no further messages will be sent unless you opt in again.

Help and support. Reply HELP to any message for assistance, or contact us at [email protected].

Message and data rates. Message and data rates may apply. Message frequency may vary. Please check with your mobile carrier for details about your plan.

Carrier liability. Mobile carriers are not liable for delayed or undelivered messages.

Age restriction. You must be at least 18 years old to opt in to or use Smart Leads' SMS messaging program.

Privacy. Mobile opt in information and consent are handled in accordance with our Privacy Policy. We do not sell or share mobile opt in information with third parties or affiliates for marketing or promotional purposes. Intellectual property and use of materials

All strategies, automations, scripts, campaign structures, templates, systems, dashboards, creative frameworks, website frameworks, sales processes, and internal assets developed or supplied by Smart Leads remain the property of Smart Leads unless otherwise agreed in writing.

The client may use the deliverables only for its own business during the term of the service. On termination, the client must stop using any Smart Leads-owned materials, systems, or assets unless Smart Leads has given written permission otherwise.

Suspension or termination

Smart Leads may suspend or limit services if the client:

  • fails to pay on time
  • causes chargebacks or payment disputes
  • withholds required access, information, approvals, or account permissions
  • behaves abusively or unreasonably
  • breaches these terms or the website terms

Either party may end the service in accordance with the agreed proposal, scope of work, onboarding records, or written arrangement. Termination does not remove the client's obligation to pay any amounts already due.

Limitation of liability

To the maximum extent permitted by New Zealand law, Smart Leads is not liable for indirect loss, loss of profit, loss of business opportunity, or loss caused by the client's own sales process, fulfilment issues, staffing issues, pricing decisions, website approval delays, operational capacity issues, or failure to follow the agreed process.

Smart Leads' total liability in relation to this package will not exceed the amount paid by the client for the affected service period, unless otherwise required by law.

Governing law

These package terms are governed by the laws of New Zealand. Any dispute will first be addressed in good faith between the parties. If it cannot be resolved informally, the dispute will be dealt with in New Zealand.

Acceptance

By proceeding with the Movers Money Maker Program, approving the proposal, approving the scope of work, confirming onboarding details, giving written approval, paying an invoice, or instructing Smart Leads to begin work, the client agrees to these package terms together with the additional Smart Leads Terms and Conditions linked below.
